US (NM): Lawsuit opened over lost crop following "fecal bacteria" incident

A cannabis company with a grow operation in Rio Arriba County is suing the state of New Mexico, alleging that some 850 plants were flooded with fecal bacteria and destroyed in 2023 when a state employee left an acequia headgate open.

In late August, Albuquerque Cannabis Corp. filed a lawsuit in district court against the state, the Los Luceros Historic Site and one of its employees, seeking relief to the tune of $442,000 for damages. These include, the suit states, the loss of crop value and the destruction of greenhouses, irrigation systems and pumps.

The state worker at the Los Luceros Historic Site in Alcalde "negligently" left open gates to an acequia during irrigation, according to the lawsuit, allowing approximately two acre-feet of water to flood the leased property for the cannabis cultivation operation at 183 Rio Arriba County 41 in Alcalde, a community about 10 miles north of EspaƱola.

Albuquerque Cannabis Corporation at the time maintained four commercial greenhouses, measuring 2,000 square feet each for a total of 8,000 square feet. Each contained approximately 212 cannabis plants, except one that contained 214 plants, for a total of 850 plants.
