Germany: Justice Ministers' Conference accepts cannabis reform proposal

Since April, the partial legalization of cannabis has come into effect. Now, the Conference of Ministers of Justice has accepted a proposal from Baden-Württemberg for a new regulation.

Smoking marijuana in small amounts and the possession of up to 25 grams of marijuana have been allowed since April 1st, with the entry into force of the cannabis law. Just three-quarters of a year later, the Conference of Ministers of Justice on Thursday accepted an initiative from Baden-Württemberg for the amendment of the cannabis law. The Federal Ministry of Justice is to review the proposal. The Minister of Justice from Baden-Württemberg, Marion Gentges (CDU), had previously called for changes to the law and, together with Berlin, submitted a request at the Conference of Ministers of Justice to allow covert investigations again.

In its resolution, the Conference of Ministers of Justice noted that the legalization of cannabis has led to a setback in the fight against the black market. Because cannabis is no longer subject to narcotics law, it has made investigations into illegal trade more difficult. The justice ministers now aim to close this gap in a reform of the cannabis law. Thus, for example, online searches and wiretapping measures should also be possible in the future for serious cannabis-related crimes.
