US (KY): New MMJ regulations approved

The General Assembly's Administrative Regulation Review Subcommittee has approved regulations setting application and annual license fees, as well as other requirements for medical cannabis businesses, which will become legal in Kentucky on Jan.1, 2025.

The non-refundable application fee for cultivators is in four tiers, and ranges from $3,000 to $30,000 based on the amount they intend to grow. For processors and dispensaries, it's $5,000, for producers it's $5,000 plus the applicable cultivator tier fee, and $3,000 for a safety compliance facility.

The state is divided into 11 regions, with at least four licenses to be issued in each region and no more than one licensee per county. However, in regions with an urban-county or consolidated government (Fayette and Jefferson counties), at least six licenses can be issued, with two locating within the merged government area. A lottery will be held to determine the licensees in each region.

Despite the hefty fees, Sam Flynn, Executive Director of Kentucky's Office of Medical Cannabis, told the panel that there has been no shortage of people seeking licenses.
